FHA

LA County owned Marina City Club 147 ADA violations and FHA report

This is in response to your inquiry re the current rejected status of the Marina City Club Condominiums project, located in Marina Del Rey, CA, with Condo ID S012275.  Based on the last review of the application package for this project on December 15, 2022, the following issues were found to be non-compliant with FHA regulations:

UNACCETPABLE LEASEHOLD ESTATE FROM LOS ANGELES COUNTY TO THIRD PARTY AND SUB-LEASEHOLD FROM THIRD PARTY TO CONDO UNIT OWNERS.  MULTIPLE ONGOING LITIGATION IN PROJECT.  INADEQUATE RESERVES FOR PROJECT NEEDS PER RESERVE STUDY REPORT SUBMITTED AT THAT TIME.

A new complete project application package may be submitted to us for review and decision.  The package must be in adherence with the information noted on page 810 of the 4000.1 Handbook and include detailed litigation documents including current status from HOA attorney and filed court documents (page 802 of HB).  Package must also include a new reserve study report with site visit.

Note: If the leasehold arrangement through LA County remains in place, project will not qualify for FHA project approval as noted in the 4000.1.  Leasehold requirements are noted on page 800 of HB

(*) Now with a new Condo Owner President this would give them Federal Jurisdiction basically taking it all away from State Court for now. This could become a class action/mass joinder for all the condo owners. It could be a way for them to get true ownership and control?
